These Terms & Conditions ("Terms") govern your use of the My Retire Score™ web application (the "Application"), operated by Nuity3 LLC ("we," "us," or "our"). By accessing or using the Application, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Application.

The Application provides a Monte Carlo retirement readiness simulation tool that calculates a personalized "My Retire Score™" based on financial inputs you provide, generates retirement readiness reports, and presents "What If" scenarios. The Application is provided for informational and educational purposes only and does not constitute personalized financial advice.

All content, reports, scores, projections, and analysis provided by the Application are for informational and educational purposes only. They should not be considered as personalized financial, tax, legal, or investment advice. The projections are based on Monte Carlo simulations using historical market data, mathematical models, and assumptions that may not reflect future performance or market conditions. Past performance does not guarantee future results. Investment returns and principal values fluctuate, and investments may be worth more or less than original cost when redeemed. You should consult with a qualified financial professional, tax professional, or estate planning attorney before making investment decisions or implementing any financial strategy.

You must be at least 18 years of age to use the Application. My Retire Score™ is not intended for use by individuals under the age of 13, and we do not knowingly collect personal information from children under 13.

You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. You agree to provide accurate and truthful information when using the Application, to use the Application only for lawful purposes, and not to misuse, disrupt, or attempt to gain unauthorized access to the Application or its systems. You are responsible for the accuracy of all financial inputs you provide; the quality of the Application's output depends on the accuracy of your inputs.

The Application, including its content, software, design, the "My Retire Score™" name and mark, simulation methodology, and all associated materials, are the intellectual property of Nuity3 LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Application without our prior written consent.

If you choose to connect with a financial professional through the Application, that professional is an independent party, not an employee or agent of My Retire Score™. They operate under their own licensing, regulatory framework, and privacy policies. We are not responsible for the advice, services, or conduct of any such professional. Any financial professionals you may be connected with are solely responsible for ensuring their marketing, advertising, and financial activities comply with all applicable state and regulatory laws.

To the fullest extent permitted by law, Nuity3 LLC and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Application. Our total liability arising from or related to the Application shall not exceed the amount you have paid us, if any, for use of the Application in the twelve (12) months preceding the claim.

The Application is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Application will be uninterrupted, error-free, secure, or that the results obtained through the Application will be accurate or reliable.

Our handling of your personal information is described in our Privacy Policy, which is incorporated herein by reference. You can review our Privacy Policy. By using the Application, you also agree to the terms of our Privacy Policy.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date" at the top. Your continued use of the Application after changes are posted constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas.

We may suspend or terminate your access to the Application at any time, with or without cause or notice. Upon termination, all provisions of these Terms which by their nature should survive termination shall remain in effect.
